2. The Service
ZapPublish provides a service for generating and publishing SEO-optimized articles ("Content") on a network of websites. Users can purchase articles for their designated campaigns using credits available in their account.
3. User Accounts
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Purchases and Payments
The Service operates on a credit-based system. Users may receive a promotional bonus upon registration and may purchase additional credits. All payments are processed through our third-party payment processor, Paddle. By making a purchase, you agree to their terms of service.
5. Refund Policy
All purchases of credits or articles are final and non-refundable.
We provide a complimentary bonus (e.g., $30 in credits) to all new users for the express purpose of testing our Service. This bonus allows you to generate several articles and evaluate the quality and suitability of our Content at no financial risk. By making a purchase, you acknowledge that you have had the opportunity to test the Service to your satisfaction using the provided bonus.
6. Disclaimer of Warranties ("As Is" Clause)
The Service is provided on an **"AS IS"** and **"AS AVAILABLE"** basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
EML MEDIA DOO does not warrant that the Service will be uninterrupted, secure, error-free, or that the Content generated will meet your specific requirements or produce specific SEO results.
7. Limitation of Liability
In no event shall EML MEDIA DOO be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Intellectual Property
Upon successful purchase, you, the User, are granted full ownership and rights to the specific Content (article) generated for you. The ZapPublish platform, brand, website, and all underlying technology remain the exclusive property of EML MEDIA DOO.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
